TERMS & CONDITIONS OF BOOKINGS
Confirmation of Appointment
At the time booking the Booking Deposit must be paid. This fee confirms and holds the sitting appointment time and enables the studio to schedule and allocate the required resources. Payment of your booking fee confirms you agree to these terms and conditions. Remaining balance must be paid before the day of the session as outlined by invoice, or your session will be cancelled. Booking deposits are non-refundable.
Watch Me Grow Monday's
Your booking is confirmed via registration on the Watch Me Grow booking page. Image selection and payment is due within 7 days of receiving your proof gallery. In the case images are not selected and finalized within this time, Capturing Moments reserves the right to select images on the clients behalf, based on images already selected where applicable, and issue an invoice for the outstanding balance.
Selection of Images
Where applicable, selection of images is required to be completed within 7 days. If more time is required, please let us know in writing. If image selection is not made within 28 days, Capturing Moments reserves the right to select and edit images on the clients behalf. An invoice will be issued for any additional images outside of your package inclusions.
Delivery of Images
Standard bookings - Capturing Moments Ltd endeavors to deliver all included images within 2-3weeks of selection of final images.
For Elopements/Weddings - Capturing Moments Ltd endeavors to deliver all included images within 12 weeks from the date of the booking. A sneak peek selection will be delivered to you within 48 hours of the end of the event.
Images are made available for viewing via a private online gallery. The online gallery is valid for 28 days, after this, images will be archived. If a gallery is needed to be extended or reloaded, a $75 retrieval fee will be charged to the client.
Editing of Images
As standard, we will remove any temporary blemishes, spots, bruises from faces and body. Permanent spots such as age and sun spots are left as is. Additional extensive edited to remove permanent marks is charged at $75 per hour.
Guarantee of Capture
Whilst all care is taken to ensure images are captured correctly and to an acceptable standard - there is no guarantee all shots or images will make the final cut. No guarantee is made that certain shots will be captured. Whilst we do take care to include any requests, images captured are dependent on co-operation and tolerance from those being photographed, as well as environmental conditions which are out of the Photographers control.
Gallery Expiration
Galleries are valid for 1 month from the date the gallery link is issued. Galleries are then archived. Once archived, there is a fee of $100 to reinstate galleries.
Sales/Promotions
Special deals including but not limited to Mini Sessions, Afterpay Day Deals, Boxing Day sales, are non refundable. Credit will be offered to the value of your purchase if not used on/by the expiry or event date wherever one is given. Payment terms not met will result in your booking being cancelled or pricing reverting to the full price.
Release Agreement & Disclamer
Copyright in all parts of the Photographic works created remains the property of Leanne Appleton of Capturing Moments Ltd. Under the Standard Terms, I/we purchase a licence to use the photographic works. I/we acknowledge that the NZIPP Standard Terms form part of this agreement and that the photographic works may be used for the photographer's marketing and business use (Unless discussed and recorded before the session). It is illegal to copy, scan, submit into contests/competitions, manipulate, crop, edit or reproduce any images without written permission whether purchased or not.
I/we acknowledge that Capturing Moments reserves the right to discontinue the service in the event of safety concerns - This includes, but is not limited to, consumption of illegal substances on the premises, intimidating behaviour by guests or clients, or harassment/threatening behavior of any kind.
In the unlikely event that the assigned Photographer is unable to attend your event, Capturing Moments Ltd reserves the right to appoint another suitably skilled Photographer to attend the event on behalf of Capturing Moments Ltd.
Cancellation - Standard Bookings
Cancellation of the Booking/Order by the Client must be in writing and must give reasonable notice to the Photographer. Subject to any specific terms in the Agreement, if the Client cancels the Booking/Order:
a. Within 1 working day of the booked shoot day, the Client must pay 100% of the Photographer’s fees
b. Giving notice of cancellation of greater than 1 working day and within 3 working days of the booked shoot day, the Client must pay a fee of 75% of the Photographer’s fees.
c. Giving notice of cancellation of greater than 3 working days and within 1 week of the booked shoot day, the Client must pay a fee of 50% of the Photographer’s fees. d The Client must pay the Photographer for all Job-Related Costs incurred.
d. The Client must pay the Photographer for all Job-Related Costs incurred. The Client acknowledges and agrees that these cancellation fees fairly reflect the loss suffered by the Photographer and the Photographer’s ability to re-schedule work and re-allocate resources, depending upon the amount of notice given.
e. Reschedule of session will incur a new deposit.
Cancellation - Elopements & Weddings
Cancellation of the Booking/Order by the Client must be in writing and must give reasonable notice to the Photographer. Subject to any specific terms in the Agreement, if the Client cancels the Booking/Order:
a. Within 90 days of the booked shoot day, the Client must pay a fee of 100% of the Photographer’s fees
b. Giving notice of cancellation of greater than 90 days and within 120 days of the booked shoot day, the Client must pay a fee of 75% of the Photographer’s fees.
c. Giving notice of cancellation of greater than 120 days of the booked shoot day, the Client must pay a fee of 50% of the Photographer’s fees.
d. The Client must pay the Photographer for all Job-Related Costs incurred. The Client acknowledges and agrees that these cancellation fees fairly reflect the loss suffered by the Photographer and the Photographer’s ability to re-schedule work and re-allocate resources, depending upon the amount of notice given.
Debt Recovery
In the event invoices/payments are left outstanding despite reminders and follow ups, Capturing Moments Ltd reserves the right to forward accounts on to a debt collection agency. All collection costs will be passed on to the client.
